California is a “no-fault” divorce state, which means you must simply state that you and your spouse or domestic partner have irreconcilable differences. It is not necessary to prove wrongdoing, nor is it necessary for your spouse to consent. To successfully file for divorce, either you or your spouse must have lived in California for six months, including three months in the county in which you file.
